BCL Rent Relief Response - May 2020 to March 2021 (now expired).

The rent relief legislation expired on 28 March 2021. BCL will still however continue to accept applications up to the 30 September 2021 for the period covered by the legislation May 2020 to March 2021.

In line with the legislation the deferred amount will be shown on future invoices as ‘Deferred rent recovery’ and may be paid over a period of time. Please email bclrentrelief@vicbar.com.au to discuss a payment plan.

Barristers’ Chambers Limited (BCL) recognises that these are extraordinary times, that barristers may be experiencing financial difficulty, and that they may need assistance in meeting their monthly chamber rent commitments.

The below outlines BCL’s response, at this time, for provision of rent relief to barristers having regard to the COVID-19 Omnibus (Emergency Measures) Act 2020 (Vic) and its accompanying regulations (together, the legislation). The Victoria Government Commercial Tenancy Relief Scheme eligibility criteria and details below.

  • The revised legislation is not retrospective to the period covered by the original rent relief response (May to September 2020). BCL will provide rent relief under the revised and further extended legislation from 1 October 2020 to 28 March 2021.
  • BCL will continue to provide rent relief under the original rent relief response criteria (May to September 2020).
  • Under the revised legislation you are required to be eligible for the JobKeeper Extension (2.0) Scheme.
  • Rent Relief is now proportional to the decline in your income; as evidenced in your Business Activity Statement (BAS) or Income Statement as provided by your clerk (see application).
  • The level of rent relief will not be capped (previously at 50% of total chamber rent). You may apply on a monthly basis or for the full quarter 1 October 2020 to 31 December 2020 or 1 January to 28 March 2021.
BCL Rent Relief Response 1 May to 30 September 2020 (superseded)

BCL made available to barristers a rent waiver for the month of April 2020 upon application by 1 April 2020 (April waiver). Taking into consideration the April waiver and the provisions of the Covid-19 commercial tenancy legislation, BCL considers that, in its current financial position, it is possible to provide further rent relief to barristers to whom the Covid-19 commercial tenancy legislation applies for the period from May 2020 to September 2020 (Rent Relief Period).
